BY ENTERING THIS SWEEPSTAKES, YOU (“ENTRANT”) SIGNIFY YOUR ACCEPTANCE OF THESE OFFICIAL RULES.

Sponsor/Administrator: WesleyLife “Portraits of Joy” Facebook Sweepstakes (the “Sweepstakes”) is sponsored and administered by WesleyLife (“Sponsor”, “Administrator”, “us”, “our”, or “we”). This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook and/or Meta. You understand that you are providing your information to the Sponsor, Administrator, and their affiliates and not to Facebook and/or Meta.

Eligibility: To be eligible to receive a prize, entrants must, at the time of entry, meet all of the following requirements: (i) be a legal resident of the State of Iowa (“Territory”); (ii) be eighteen (18) years of age or older and the age of majority in the entrant’s jurisdiction as of the date and time of participation and entry; and (iii) be a registered user of Facebook. If you are not already a registered user of Facebook, it is free to join. Subject to all federal, state, provincial and local laws and regulations. Participation constitutes Entrant’s full and unconditional agreement to these Official Rules and Sweepstakes Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Void in Puerto Rico, all U.S. territories and possessions not listed herein, and overseas military installations and where prohibited or restricted by law.

Timing: The Sweepstakes begins at 12:00:00 a.m. ET on June 26, 2024, and ends at 11:59:59 p.m. ET on July 21, 2024 (the “Promotion Period”). Sponsor will be the official time keeping device for the Sweepstakes and all decisions by the Sponsor regarding the timing of entries and the order in which they are received will be final and binding.

How to Enter: During the Promotion Period, visit the official WesleyLife Facebook page at www.Facebook.com/WesleyLifeSeniorLiving. To enter, review the WesleyLife “Portraits of Joy” Facebook Sweepstakes Official Rules and acknowledge WesleyLife’s Privacy Policy, then “like” at least one of the identified “Portraits of Joy” posts appearing on the page’s feed between June 26, 2024 and July 21, 2024 (the “Participation Action”). Upon completion of your Participation Action, as evidenced by your “like”, you will receive a maximum of one (1) entry in the Sweepstakes for performing the foregoing activities regardless of the number of Participation Actions.

For all entries: All entries must be received by Sponsor online in accordance with these Official rules during the Promotion Period. Entrants are not permitted to share the same email address. Any attempt by any Entrant to obtain more than the permitted number of entries by using multiple/different identities and logins, or any other methods will void that entrant’s entries and that entrant may be disqualified. As between you and the Sponsor and Sweepstakes, all entries, and any content therein, become the exclusive property of Sponsor, and none will be acknowledged or returned. Use of any automated system to submit entries is prohibited and will result in disqualification. In the event of a dispute as to any online entry, the authorized account holder will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Potential winner may be required to show proof of identity as the authorized account holder.

Sponsor may, in its sole discretion, accept or reject any purported Participation Action that does not comply with these Official Rules. Purported Participation Action that are received outside the Promotion Period, or that contain obscene, offensive, or any other language communicating messages inconsistent with the positive images with which Sponsor wishes to associate itself (all as determined by Sponsor in its sole discretion) will be void and disqualified. Sponsor is not responsible for misspellings, typographical errors, or other issues that may affect the ability to locate or record a purported Participation Action. Due to the way the Facebook service is operated, Sponsor may not be able to view or record purported Participation Action, receive, or send communications, or otherwise detect participation from or interact with potential Entrants who have Facebook account settings that make their updates, comments, posts, or communications private, protected, or otherwise limited, in which case any such purported Entrant will be disqualified and ineligible to receive a prize. Normal Internet access and phone/usage charges imposed by your online/phone service may apply. Each Participation Action must be manually key stroked and manually entered by the individual Participant; automated and/or repetitive submission of Participation Action (including but not limited to entries made using any script, macro bot, or sweepstakes service) will be disqualified.

NOTE ABOUT MOBILE DATA AND MESSAGING CHARGES: When you participate in the Sweepstakes via a mobile device and/or download or transmit data via your mobile device, data and messaging rates may apply according to the terms and conditions of your service agreement with your wireless carrier. Other charges may apply (such as normal airtime and carrier charges) and may appear on your mobile phone bill or be deducted from your prepaid account balance. Wireless carriers' rate plans may vary, and you should contact your wireless carrier for more information on rate plans and charges relating to your participation in this Sweepstakes. Check your mobile device’s capabilities for specific instructions.

Prize: One (1) prize, as described below, will be awarded in this Sweepstakes.

Prize description: The prize consists SOLELY of one (1) free two-hour individual, friend or family professional photography session, with no more than a total of six (6) people, and a digital file of all photos taken, with up to five (5) edited images of their choice (photo prints are not included) (the “Prize”). The photography session must occur within the State of Iowa and will be held at a public venue located within thirty (30) miles of the verified Prize winner’s primary residence, which venue will to be determined by Sponsor in its sole discretion (“Photo Session”). The verified Prize winner must schedule the Photo Session prior to October 31, 2024, and the Photo Session must occur on a date that the photography team is available that is no later than December 1, 2024. By participating in the Promotion, the verified Prize winner agrees all photographs are the property of the photographer, who retains all copyrights to all images, including but not limited to the right to use, reproduce and distribute the photographs for advertising, marketing and promotional purposes, as well as for use on social media platforms. The verified Prize winner may only use the Prize images for his/her/their personal use and any unauthorized use or reproduction of the photographs is strictly prohibited.

Prize Approximate Retail Value: The total Approximate Retail Value (“ARV”) of the Prize is five-hundred dollars ($500.00 USD). No substitutions, transfers or cash redemption are allowed.

Winner Selection: Subject to compliance with these Official Rules, on or about August 1, 2024, Sponsor will select one (1) potential Prize winner among all valid entries received by Sponsor during the Promotion Period. Sponsor will contact the potential Prize winner(s) via Messenger by sending a message to the profile name of the potential Prize winner’s account who liked Sponsor’s post as provided in these Official Rules. Failure by the potential Prize winner to respond to the initial verification within seventy-two (72) hours of notification may result in disqualification, and Sponsor may, at its sole discretion, select an alternate potential Prize winner from all remaining valid entries. The entrant who is selected as the verified Prize Winner selected must comply with all terms and conditions of these Official Rules, and verification of winning the Prize is contingent upon fulfilling all requirements. If requested, and except where prohibited, to be verified, the potential winner must sign and return to Sponsor, within five (5) business days of being notified, an affidavit of eligibility and liability/publicity release in order to claim the Prize. The verified Prize winner awarded the Prize will be solely responsible for all applicable federal, state and local taxes on the Prize and may receive an IRS Form 1099 for the retail value of the Prize and must provide Sponsor with a valid social security number if requested for tax reporting purposes. All expenses associated with the receipt and use of the Prize not specifically mentioned herein are solely the responsibility of the verified Prize winner. Sponsor is not responsible for any delay or cancellation of the Prize delivery due to unforeseen circumstances, or those outside of Sponsor’s control. Odds of winning the Prize in this Sweepstakes depend on the number of eligible entries received during the Promotion Period.

Release: By receipt of the Prize, verified Prize winner agrees to release and hold harmless the Sponsor, Facebook and/or Meta, and their respective parent companies, subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of the Prize. 

General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion, and Sponsor disclaims any liability for such events. If terminated Sponsor may, in its sole discretion, determine the winner from among all non-suspect, eligible entries received up to time of such action using the procedure outlined above. Sponsor, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner and void all associated entries. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages and other remedies (including attorneys’ fees) from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

Limitations of Liability: Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrant, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone/internet lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) printing, typographical, technical, computer, network or human error which may occur in the administration of the Sweepstakes, the uploading, the processing or judging of entries or votes or the tabulating of votes, the announcement of the Prize or in any Sweepstakes-related materials; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of the Prize (including any travel/activity related thereto). Released Parties are not responsible for misdirected or undeliverable entries or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Released Parties are not responsible for any unauthorized third party use of any entry. 

Governing Law / Disputes: Entrant agrees that: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant(s) and Sponsor and their agencies, shall be governed by and construed exclusively in accordance with the laws of the State of Iowa without giving effect to any choice of law or conflict of law rules which would cause the application of the laws of any jurisdiction other than the State of Iowa. Entrant agrees that any action at law or in equity arising out of or relating to this Sweepstakes, or awarding of the Prize, shall be filed only in the state or federal courts located in the State of Iowa. Entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action. Except where prohibited, by participating in this Sweepstakes, entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or awarding of the Prize, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Sweepstakes but in no event attorneys’ fees; and (c) under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitations or exclusion of liability for incidental or consequential damages, so the above may not apply to you.

Severability: If any term of provision of these Official Rules is found under the law to be invalid or unenforceable, then such specific term or provision shall be of no force and effect and shall be severed and the remainder of these Official Rules shall continue in full force and effect.
